Planning a staff summer barbecue? Employers can cover the costs of certain social events for their employees without creating a tax liability. This exemption, which was once a concession, is now part of statutory regulations, provided certain conditions are met.
Understanding the Annual Party or Function Exemption
The exemption applies to an “annual party or similar function” that is available to all employees or to all employees at a particular location. HMRC has even confirmed that virtual parties can qualify under this exemption, a clarification made during the Covid-19 pandemic.
Key Conditions for Tax-Free Staff Events
Cost Per Head Limit: The cost per head for the event must not exceed £150, inclusive of VAT. If the cost goes over this amount, the entire cost becomes taxable, not just the excess.
Multiple Events in a Year: If you’ve already held a Christmas party, you can still host another event, like a summer barbecue, and both can be exempt from tax, provided the combined cost per head for the year does not exceed £150. If the combined cost exceeds this limit, the employer can choose which event to apply the exemption to for optimal tax benefits.
Example Scenario
Christmas Party: Cost per head is £100.
Summer Barbecue: Cost per head is £70.
In this case, you can nominate the Christmas party for the exemption, making the £70 Summer Barbecue taxable. However, the employer can manage the tax and National Insurance on behalf of the employees through a PAYE settlement agreement, avoiding direct tax implications for the employees.
